As of Oct 7, 2026, kratom is legal, but 7-hydroxymitragynine (7-OH) is scheduled or restricted in Florida (Fla. Stat. § 500.92 (2026)). Minimum age: 21. 7-OH: 7-OH ≤ 1 mg/g (solid/powder) or ≤ 1 mg/mL (liquid), and ≥100 parts mitragynine per part 7-OH; above that 7-OH is Schedule I. 3 changes in 2026: Emergency rule 2ER26-1 (2026-07-01) then 2ER26-2 (2026-08-18) replaced the 400 ppm threshold with 1 mg/g or 1 mg/mL plus a 100:1 mitragynine ratio, and added 7-acetoxymitragynine, MGM-15 and MGM-16 to Schedule I; Second ratio condition of 2ER26-2; HB 1205 (2026 Florida KCPA with processor permits) died; the 7-OH scheduling provision was not part of enacted CS/SB 432 (Ch. 2026-148), whose enrolled text contains no kratom/mitragynine provisions.
