As of Oct 7, 2026, kratom is legal and regulated by a state kratom law in Nebraska (Neb. Rev. Stat. § 71-3803). Minimum age: 21. 7-OH: Registration COA must certify 7-OH less than two percent of the alkaloid composition. One change in 2026: LB 901 (approved by the Governor 2026-04-07) adds a 10% retail excise tax on kratom products from 2027-01-01 and amends the adulteration/testing section (§ 71-3809). LB 431 (Schedule I for mitragynine/7-OH) was indefinitely postponed 2026-04-17.
